Insurances
Proof of Dive Injury Insurance is compulsory for all diving passengers on all liveaboards and resorts. Proof of Medical Evacuation (Air) Insurance is compulsory for all passengers on all liveaboards and some resorts. We also strongly recommend all customers to purchase a good Travel Insurance (Trip Cancellation and Interruption Insurance).

Inquiry
After you fill out the book now / inquiry form you will receive an email with your free shortlist of options and availabilities for scuba vacations. The email that we send you contains the best recommendations to match your requirements that you identified in the enquiry form. Confirm immediately to avoid disappointment and to prevent the option being unavailable due to another customer booking it.
 
Confirming your intention to purchase
When you decide upon your desired vacation option, then you can confirm your intention to purchase by email. Please ensure that you mail us clearly which option you desire. For hotel arrangements, additional tours, etc, before and/or after the cruise inform us on specific dates and wishes.
 
Provisional booking confirmation
When we receive notice of your intention to purchase, we will send you an email with instructions on how to make your full payment or your confirmed reservation deposit.

Confirmed Reservation Deposit
A confirmed reservation deposit is payable by you, to guarantee your reservation. The non-refundable deposit required is 30% of the total price of your dive trip booking.
Additional hotel reservations and domestic flights are to be paid in full, in combination with (additional to) the confirmed reservation deposit. These payments are non-refundable. Our staff will do their utmost to help you if changes of bookings for hotels and domestic flights are needed. A fee might be applicable.

Confirmation of Reservation Completed
As soon as we receive your confirmed reservation deposit then we shall inform the operator of your reservation. As soon it is confirmed by the operator that the reservation process is complete we will send you confirmation of reservation completed.
 
How a contract is made
Please note that the way a contract is formed on-line for the purchase of a retail product will be different from the way scuba diving vacation packages or courses are purchased through Scuba Dive Asia.
Our business operates to an agency model. This means that we act as a disclosed agent for third party suppliers, such as PADI centers, liveaboard operators or other dive operators, hotels and resorts. We gather all the information and representations from the operators and put it all in one place for you. We do our best to verify and update this information as much as is practical. Since we act as agents this means that we have no contractual liability to you in respect of the product. However we may still be liable to you if we have been negligent, if we have misrepresented important information or have been in breach of any other relevant law.
What this means is that the contract for the product is between you and the operator. In most cases this will mean that there are additional terms and conditions governing the contract as each operator will have terms and conditions relating to their vacations. Please make sure that you have read these terms and conditions before completing your transaction with us. You can easily request them from us.
The technical steps required for a contract to be formed are as follows:
When we place products on the site we are inviting you to make an offer for their purchase. You do not make this offer until you communicate an “Intention to Purchase” (i.e. not a general enquiry). Your offer is an offer to purchase the products from the operator for whom we are acting as agent. We are authorized by each of the operators to accept this offer on their behalf. After checking availability we send our "Provisional Booking Held Notification" and in doing so we are accepting your offer and requesting a payment. Once payment is received there is a binding contract between you and your supplier for the product.
Please note that once the payment is received you can only cancel the diving product in accordance with our terms and conditions. It is your responsibility to ensure you are familiar with any cancellation charges relevant to your booking.
 
Making your final payment
You will make your final payment of your package price (normally the remaining 70%) to be received by us more than 90 days before the commencement date. Therefore, it is important to allow time for the transaction to be finalized before this 90 day requirement. We will endeavor to keep you informed, by email, of the final payment amount and due date. Failure to pay your balance prior to such due date will be considered as cancellation by you within 90 days before the package commencement date and you will be subject to the terms and conditions that apply in the event of customer cancellation.
 
Payments method
All payment instructions and details are sent to you by email when a payment is required.
Payments are to be made by bank transfer, credit card or PayPal.
All bank transfer charges are to be paid by the sender. For credit card and PayPal payments a surcharge of 3.7% applies.
In order to minimize your bank charges we recommend that you consider paying the full total of your package immediately, rather than first a deposit and then the balance at a later time.
Please help us to help you, by emailing a scan / pdf copy of the transfer record that includes the transaction reference number.
 
Canceling your booking
If you decide to cancel your reservation 90 days or more before your package commencement date then we will return your payment less the deposit and any bank charges incurred by us. If you cancel your reservation any less than 90 days before your package commencement date then we retain the right to keep any payments in compensation for potential lost bookings.
Please inform us of any changes to your booking at the soonest opportunity. The date that Scuba Dive Asia receives the cancellation of the reservation by email will be the date used to determine whether a fee will be charged. On Saturdays, Sundays and public holidays the next working day will count.
 
Changing your booking
If you decide to change your booking after you have made your reservation we will do what we reasonably can to accommodate you but it may not always be possible. You should notify us as soon as possible of any changes as the sooner you do this the more likely it is that we can make the change. There will be an administration fee of US$ 100 (in addition to any changes necessary to the price of your reservation) for any booking changes 91 days or more prior to the departure date, and which require the issue of a new Confirmation of Reservation Completed or invoice including, but not limited to, changes in dates, room type and diving program.

Liability Release & Assumption of Risk
Scuba Dive Asia cannot be held liable for and will not be responsible for personal injuries, property damage, or wrongful death that may occur during activities, as a result of the inherent risks associated with scuba diving or as a result of acts or omissions of other third parties.
Diving requires a certification from a recognized dive agency such as PADI. It is your responsibility that you are suitably qualified, and provide proof of such qualification upon request, to participate in any scuba activities prior to you taking part. Such activities include all activities other than PADI Open Water Diver or Scuba Diver Course, or Discover Scuba Diving activities that allow participants to take part without a license.
 
Unforeseen events
If departure of your cruise is not advisable - or may be dangerous to the life or health of the passengers or to the boat, due to conditions such as: bad weather, perils of the sea, Acts of God, political incidents, force majeure - then the captain has the sole discretion to delay or cancel the cruise departure.
Likewise during the cruise, if bad weather or force majeure events occur that make it inadvisable for passengers to land or for the boat to enter port, then the captain shall have the right to delay or postpone sailing until conditions allow, and to make adjustments to the itinerary that may include cancellation of calls to ports, or the re-sequencing of island visits.
In accordance with the industry norm, cancelled cruises and vacations entitle you to a 100% refund of monies paid, less any bank charges incurred. Re-sequencing of destinations is not considered satisfactory justification for a refund.
In the unlikely event of a cruise being cancelled due to insufficient reservations we will alert you to this as soon as we become aware of the danger. In these circumstances we will take all reasonable steps to ensure you receive an alternative and comparable cruise.
 
Political unrest
If there is any political unrest, military conflict, flight cancellations, or any other risk to customers or vessels due to political unrest, then Scuba Dive Asia has the right to cancel vacations to this destination.
In this event, we will re-route your cruise to another destination at no extra cost. However, in these circumstances we are unable to consider this justification for you to cancel your cruise, and will therefore not be able to authorize any refund or compensation in this event.
 
Miscellaneous terms
If there are any changes to the details supplied to us by you it is your responsibility to inform Scuba Dive Asia as soon as possible. In particular we will not be responsible for problems arising from your failure to adhere to instructions in our emails or correspondence (e.g. late changes to your transfer information, your failure to satisfy permit documentation requirements etc).
All fares are quoted inclusive of taxes unless otherwise stated. Our prices reflect operator / supplier prices and are therefore subject to changes that they may make without prior notice. We will inform you of such changes as soon as possible.
Please note that the number of dives we quote in our packages is a best estimate based on normal circumstances, not a guarantee. Circumstances may arise during vacations (weather, illness, personal choice) where the total number of dives done is less than the number we estimate. There will be no partial refunds in these circumstances.
It is incumbent upon you to ensure that you meet the passport, visa, health requirements of the countries you wish to visit and those that you transit.
Like other online sales agents our website will not stop you from making impossible bookings such as two different liveaboard trips at the same time or where you book diving on the same day as a later flight. It is your responsibility to ensure that you do not make such reservations.
We will do our best to correct errors and omissions as quickly as practicable after being notified of them. However because of the sophisticated technology that is required in operating Scuba Dive Asia there may be times when obvious errors occur. For example, very occasionally, this may result in a package price, product or other detail displayed or presented on our website being incorrect. In this case we will do our best to correct the terms or revise them to mutual satisfaction, notwithstanding we reserve the right to cancel that contract, but this of course will be without any liability to you.
